Profile
Tim Misner represents clients in all phases of civil litigation, from factual development to appeals. His experience covers a wide range of practice areas, including breach of contract, antitrust, unfair and deceptive trade practices, mass tort and governmental disputes.
In addition to his litigation practice, Tim assists companies in obtaining antitrust clearance for significant mergers and acquisitions.

Represents the Southeastern Conference in multidistrict putative class action litigation challenging NCAA rules relating to name, image and likeness.
Represents the Southeastern Conference in 11 "single-school, single-sport" putative class actions (MDL centralization in Illinois) filed by former football student-athletes related to concussions in college sports.
Represents a national convenience store in a putative class action filed by customers alleging unfair trade practices and other tortious conduct.
Obtained dismissal, without discovery, of a putative class action alleging unfair trade practices filed against a local credit union.
Complex Business Litigation
Represents debtor as special counsel for asbestos claims estimation matters in In re Bestwall LLC, Case No. 17-31795 (Bankr. W.D.N.C.).
Represents debtor as special counsel for asbestos claims estimation matters in In re DBMP LLC, Case No. 20-30080 (Bankr. W.D.N.C.).
Obtained a summary judgment order in favor of a home builder who was sued for specific performance of a real estate contract and successfully argued for affirmance of that order on appeal.
Represents financial institutions and investment advisers in FINRA arbitration proceedings.
