Profile
Emma Kutteh advises and represents clients in complex commercial disputes across a range of industries, including banking and finance, manufacturing and consumer products. She has experience litigating in federal courts across the country, including in multidistrict litigation and class actions, and has defended clients against commercial fraud, employment discrimination, wage-and-hour and mass tort claims. A certified public accountant and former auditor, Emma brings particular experience to matters involving finance and accounting issues.
In addition to her litigation practice, Emma represents clients in investigations by federal and state enforcement agencies. She also assists companies in obtaining antitrust clearance for significant mergers and acquisitions.

Complex Commercial Litigation
Represents a national bank in a putative nationwide class action (MDL centralization in Boston) regarding what is alleged to be one of the largest Ponzi/pyramid schemes in U.S. history.
Represents a national fast-food chain in defense of a wage-and-hour class action consisting of more than 5,000 employees who assert claims of off-the-clock work.
Represents a multinational conglomerate in multidistrict litigation containing more than 1,000 lawsuits alleging product liability related to per- and polyfluoroalkyl substances.
Obtained dismissal of a fraud claim in a North Carolina Business Court case against a pork processing company.
Represented a group of sellers in a lawsuit filed against a purchaser firm alleging breach of contract claims concerning post-sale conduct.
Antitrust (Transactions)
Regularly assists clients in advising on and obtaining antitrust clearance for significant transactions, including:
An industrial technology company in the acquisition of an advanced manufacturing business focused on the semiconductor value chain.
An agricultural company in the review of potential strategic acquisitions.
An industrial technology company in antitrust issues related to a potential transaction.
Investigations
Regularly represents a variety of clients in government investigations, including investment management, health care and technology companies.
