Robinson Bradshaw recently secured the dismissal of an ERISA class action lawsuit against Atrium Health in federal court. A proposed class of former employees sued the hospital system, alleging that its employee medical, pension and 401(k) plans should not be entitled to exemption from ERISA. In his dismissal, U.S. District Court Judge Thomas D. Schroeder agreed with Atrium's argument that as a political subdivision, its employee benefit plans are "governmental plans" and therefore are not subject to ERISA.
